Industrial Plot for Sale Location: Vamvakia Elefsinas, on the Athens-Corinth national road Building Block and Plot Number: R14-01 Land uses: Law 3982/2011 Business Parks Law 3982/11 Article 62 Incentives Every sale and donation contract of a plot to the EANEP for the securing of the plot within the meaning of paragraph 1 of article 46, as well as a plot within a Business Park from the EANEP or from a business that has been established, is going to be established, or is going to be relocated within the Business Park, is exempt from the transfer tax and the donation tax, respectively. The business benefiting from this incentive must, for five (5) years from the date of signing the contract, not transfer the said area to a third party and must operate in it an activity of Article 43 paragraph 1 for at least the same period. Similarly, the transfer provided for in paragraph 2 of article 48 is exempt from tax. 2. The fees for the notary and the unpaid or paid registrar for the registration of the above transactions cannot exceed 8,000 euros for the notary and 4,000 euros for the registrar. The aforementioned amounts may be adjusted by a decision of the Ministers of Finance, Economy, Competitiveness and Shipping, and Justice, Transparency and Human Rights. 3. The businesses of the Second Party of the present, as well as the businesses of Article 1 of Law 4302/2014 that relocate to business parks, are exempt from paying income tax on the capital gains resulting from the disposal of their properties and other facilities, to the extent that corresponds to the cost of their relocation. If, within five (5) years from the relocation, the business ceases to operate within the business park, it is obliged to return the amount of the tax exemption with the legal surcharges. The amount subject to exemption is included in the amount of public funding, provided that the subsidized enterprise is included in a financing program that corresponds to a percentage up to the maximum permissible limit, as stipulated by the currently applicable Regional Aid Map for each Region of the Country. Law 4982/22 Article 29 Licensing incentives 1. For activities developed within Business Parks (B.P.), approval or notification of installation is not required. For the activities developed within the Business Parks (B.P.), approval or notification of installation is not required. A prerequisite for the establishment of businesses in the Business Park (B.P.) is the issuance of a compatibility certificate for the activity by the Business Park Development and Management Company (B.P.D.M.C.), depending on the type of B.P. and the terms governing it, in accordance with the development approval decision and the implementation urban planning plan. A similar certificate is required in the case of modernization of production equipment and expansion of the activities of the established businesses within the E.P. 2. For the issuance of an Environmental Terms Approval Decision (E.T.A.D.) for an activity that is established in the E.P., the opinions of the competent services required by articles 3 and 4 of the law are not needed. For the issuance of an Environmental Terms Approval Decision (E.T.A.D.) for an activity that is installed in the E.P., the opinions of the competent services required by articles 3 and 4 of Law 4014/2011 are not needed. 4014/2011 (A&#***/*******)and Annex B of the joint decision No. 1649/45/2014 of the Ministers of Interior and Environment, Energy, and Climate Change (B&#***/*******)provided that they are covered by the opinions given during the environmental licensing of the E.P. Exemptions do not apply to opinions on the utilization of produced electrical and thermal energy, the management of solid waste, the suitability of raw materials used, and the produced products, provided that these are required. The process of public disclosure and consultation of the Environmental Impact Study, according to the aforementioned joint decision, is still required. The established enterprises notify the E.A.D.E.P. of the A.E.P.O. of their activity, as well as the modifications and renewals.
